These Terms of Service ("Terms") govern your access to and use of the CafOS mobile application, website, and related services (together, the "Service"). The Service is operated by Jonathan Rashed, a sole proprietor established in the European Union ("CafOS", "we", "us", or "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
Not medical advice. CafOS is a wellness and informational tool. It estimates blood caffeine levels using a pharmacokinetic model and general assumptions. These estimates are not a diagnosis, medical advice, or a substitute for professional healthcare. Individual responses to caffeine vary. Always consult a qualified healthcare professional regarding caffeine intake, sleep, medication interactions, pregnancy, or any medical condition.
1.Eligibility
You must be at least 16 years old (or the minimum age of digital consent in your country) to use the Service. By using CafOS you confirm that you meet this requirement and that the information you provide is accurate.
2.Your account
Some features require an account, which you may create using a third-party sign-in provider (such as Google). You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use.
3.The Service
CafOS lets you log caffeine intake, view an estimated blood-caffeine curve, receive a personalized cutoff time, and track a long-term wellness score. All calculations are estimates generated by a pharmacokinetic model and depend on the accuracy of the information you enter. We may add, change, or remove features at any time.
4.Subscriptions, pricing, and billing
- Free — basic tracking, limited history, and a generic cutoff time at no cost.
- Premium — €4.99 per month, billed in advance, with personalized cutoff, lifetime score, reset protocol, weekly insights, and unlimited history.
- Lifetime — a one-time payment of €39 granting Premium features for the lifetime of the app, where offered.
Subscriptions purchased through the Apple App Store or Google Play are processed and managed by those platforms and are subject to their terms. Auto-renewing subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours beforehand through your app store account. Prices are shown in euros and may include applicable taxes. Refunds are handled in accordance with our Refund Policy.
5.Acceptable use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to access, probe, or disrupt our systems or other users' accounts; (c) reverse-engineer, copy, or resell the Service except as permitted by law; or (d) rely on the Service as your sole source of health decisions.
6.Intellectual property
The Service, including its software, design, branding, and content, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for your own non-commercial purposes. The data you enter remains yours.
7.Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of estimates. We do not warrant that the Service will be uninterrupted, error-free, or that calculations will reflect your actual physiology.
8.Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages, or for any decisions you make based on the Service. Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law, including your statutory consumer rights in the EU.
9.Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or if required to protect the Service or other users. You can request deletion of your data as described in our Privacy Policy.
10.Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the app or by updating the date above. Continued use after changes take effect constitutes acceptance.
11.Governing law
These Terms are governed by the laws of the European Union and of the EU member state in which the operator is established, without prejudice to the mandatory consumer-protection rights available to you in your country of residence. Disputes will be subject to the courts competent under those laws.
